A prison sentence has been imposed on a woman in her 30s following her allegations against her biological father—who had financially supported her international education—accusing him of rape after he denied her monetary requests.
As reported by the legal sector on the 1st, the Criminal Division 1 of the Namyangju Branch of the Uijeongbu District Court, under the jurisdiction of Presiding Judge Choi Chi-bong, sentenced the woman, referred to as A, to 10 months of imprisonment. The charges included defamation, business obstruction, and insult.
In this instance, a daughter in her 30s, who had her foreign education funded by her biological father, received a custodial sentence for wrongfully labeling him as a sexual offender due to financial disagreements. The image is unrelated to the article. [Photo courtesy of Pixabay@Engin_Akyurt]
A faced legal proceedings after making 11 defamatory posts on an online platform between May and June of the previous year, titled "I am a victim of familial sexual violence. Please look at this," targeting her father, B.
Her posts included fabricated claims such as, "My biological father has continually sexually assaulted me since the age of four," and "My mother also endured domestic and sexual violence." She alleged, "The case was settled for 30 million won," and insisted on "severe punishment."
In these postings, A revealed B's actual name and business details, reportedly causing him operational challenges in his business.
Further accusations from A included six additional posts alleging that B married C, a woman he purportedly had an affair with.

A initiated a lawsuit seeking damages for alleged sexual assault against B in February 2021 at the Incheon District Court. However, she was unable to substantiate any illegal actions.
Throughout the criminal proceedings, A maintained that her allegations were factual, but the court dismissed her assertions, referencing the civil lawsuit's outcome. The court highlighted the absence of evidence indicating B's habitual sexual abuse of A.
Moreover, the court deemed A's allegations unfounded, emphasizing that her father had provided financial backing for her education abroad and upon her return. Her rape accusation coincided with a denied large financial request to start a cafe.

The court articulated, "She disseminated false information about the victims due to dissatisfaction over financial denial. The reputations of the affected parties have been irrevocably harmed."
In justifying the punishment, the court cited, "The elevated risk of reoffending, as demonstrated by her continued publication of similar content post-crime, alongside the victims' fervent demand for stringent punitive measures against the defendant, were key considerations."
